Warranty
The original purchaser of Brookline Furniture is protected against defective
workmanship for one year from date of purchase. This warranty does not cover
fabrics supplied by us or customers. We will replace or repair at our option,
any furniture deemed defective, free of charge, provided it is returned promptly
as directed, freight prepaid. Liability shall never exceed original purchase
price of the furniture. Deductions for repairs in field will not be allowed
without written authorization. This warranty does not cover damage by accident,
abuse, neglect, or misuse.
TERMS AND CONDITIONS OF SALE
Acknowledgement:
All orders are acknowledged with an anticipated shipping date which is subject
to change due to conditions beyond our control. The acknowledgement should
be examined immediately upon receipt and any discrepancies should be communicated
to Brookline Furniture Customer Service.
Customer is responsible to inform Brookline Furniture of any discrepancies
within 10 days of Order Acknowledgement. After the 10-day period, Brookline
accepts no responsibility for misinformation. Once an order is accepted, orders
cannot be canceled without prior written permission from Brookline.
Order Changes:
Brookline Furniture can only accept changes under the following conditions.
Written confirmation must be received before any changes can be acted upon.
Order changes are to be made in writing through Brookline Furniture Customer
Service only. Changes may be subject to additional charges for material,
labor and administrative cost. Changes may result in rescheduling of an
order. Any changes are subject to the factory’s ability to conform,
and no changes will be accepted after the fabric has been cut.
Terms:
Net 10 days. 1.5% interest per month will be charged on accounts over 30 days
past due. For accounts not related or listed with a recognized credit agency
full payment may be required when order is placed. We reserve the right to
change credit terms at any time.
Pricing:
Prices are subject to change without notice. All prices are quoted F. O. B.
High Point, N. C. and shipments made freight collect unless arrangements
have been made in advance, "prepaid and add" shipments are subject
to a service charge.
Shipping:
All Brookline products are shipped poly-wrapped. When cartons are required,
add $22 per sofa or loveseat and $14 per chair. Twelve pieces or less will
be boxed.
Freight Claims, Returns:
When a common carrier signs for a shipment he becomes the agent of the purchaser
and consignee. The title to the product passes to the purchaser. We have
no responsibility for goods in transit. If there is loss or damage, make
an immediate claim with the carrier. Claims against us will not be considered
unless we receive in writing such claims within 10 days of receipt of the
product. Brookline Furniture will not accept for return any product without
prior written authorization from us. Authorized returns are subject to a
15% restocking charge. Special orders are not subject to return. No field
repair will be reimbursed without prior written authorization.
Our intent is to be fair and reasonable in resolving any difficulty. Agreements
reached with the sales representatives are not binding on the company. Final
authorization must come from the customer service department.
Freight Charge:
All shipments are made F.O.B Factory, Freight Collect. Freight charges are
determined by the delivering carrier’s tariff. Without prior credit approval
with the carrier, freight charges are normally collected on the delivery of
the product. In many cases, it is not feasible to submit payment at the time
of delivery. Therefore, it is advisable that credit payment and billing arrangements
be established with the delivering carrier prior to shipment. Brookline Furniture
will not be liable for delays in performance by acts of God, strikes, accidents,
government action or other reasons outside of our control.
Storage:
We reserve the right to transfer to storage when a customer cannot accept delivery.
All costs will be invoiced to buyer’s account. Such transfer constitutes
shipment, including invoicing as of date transfer is made.
Delivery:
Established lead-times are based on 6 to 8 weeks from the later receipt of
deposits, COMs, any approvals, and complete order information. Customer
assumes all responsibility for any delays in conveying proper deposits, COMs, or information for an order.
Orders shall be deemed delivered when order is completed and invoiced.
Abandonment and Collection:
Orders not paid for and picked-up within 90 days of invoice date shall be considered
abandoned. In addition to any legal remedy available by law, deposits, furniture
ordered, and any COMs shall be liquidated and applied against unpaid invoices.
Deposits for other pending orders may also be liquidated and applied against
unpaid invoices. Customer shall be liable for any collection and legal service
fees incurred in the
collection
of unpaid
invoices.
Reorders:
Brookline cannot guarantee exact match or availability of any reorders for
product once original order product has been shipped. Due to changing requirements
for emissions of finishing product and supply availability, Brookline cannot
guarantee exact match for reorders when original product is returned for
matching.
Specification:
Brookline’s specifications such as dimensions, frame construction and
components can change from catalogue information without notice as new and
better more cost effective procedures become available.
